Terms and Conditions

Terms and conditions | De Spaanse Hypotheker

The Terms and Conditions apply to the tenders and agreements in which De Spaanse Hypotheker performs services in connection with the application and mortgage consultancy to a client. Client is defined as the client for mortgage brokering.

The free Mortgage Check gives an indication of the possibilities and financing conditions. This is in no way a final approval of the bank and no rights can be derived from it.

In the event of a cessation of service by or on behalf of the client, De Spaanse Hypotheker is entitled to keep any payments made by the client, as compensation for costs and activities by De Spaanse Hypotheker

If the information provided by the client is not sound or incomplete, De Spaanse Hypotheker is entitled to suspend the application.

The liability of De Spaanse Hypotheker is limited to the amount equal to the mediation costs.

The liability of The Spanish Mortgager for indirect damages, consequential damages and foregone profits is excluded.

De Spaanse Hypotheker is not liable for a failure or improper action of the mortgage lender.

De Spaanse Hypotheker charges a fixed fee of 2.500 € for mortgage advisory in Spain, regardless of the mortgage amount or the complexity of the file.

When the order is given for the consideration of the mortgage application, 1,250 € (50% of the total fee), must be paid in advance). Upon receipt of the payment, the application is binding.

Where an ´Agreement subject to valuation´ is issued by the financing entity, the remaining 1,250 € of the fee will be paid. In the case of no or late payment of the fee, De Spaanse Hypotheker has the right to suspend the mortgage application.

Cancellation of a mortgage application can only be done by the original applicant, by means of a written request for cancellation, which can be delivered by mail.

The offers made by De Spaanse Hypotheker are an indication and subject to the bank’s approval. De Spaanse Hypotheker is not liable for damages as a result of the client misinterpreting a tender made by De Spaanse Hypotheker.

By starting a mortgage application, the client indicates that he will accept the Terms and Conditions.

Spanish law applies to the Terms and Conditions. Disputes arising will be presented in Malaga.
